My opinion is that Option 1) is the most likely course of action. Will things change if he is? I don't know, again it may come down to what's in his contract as a celebrity persona. I think another big issue is the actual legal system - Jared hasn't been convicted of any crime. Who owns the character? Does Jared own Diath? Does Wizards? How are contracts written for CNE's usage? There's tons that the public will never know that goes into making final decisions.
